What probate actually is
Probate is the court process of validating a will and distributing someone's assets after they pass away. In Texas it's more streamlined than in many states, but it can still mean months of waiting, legal and court costs, and a public record of your family's affairs — all at the worst possible time, while your loved ones are grieving.
Three ways to keep assets out of probate
1. A revocable living trust. Assets titled in your trust pass directly to your beneficiaries without probate, privately and quickly. For most Houston families with a home and savings, this is the cornerstone document.
2. Beneficiary designations. Life insurance, IRAs, and 401(k)s pass directly to the people you name — and those designations override your will, so keeping them current is essential.
3. Payable-on-death and transfer-on-death titling. Texas lets you add these designations to bank and brokerage accounts, and even to real estate through a transfer-on-death deed, so they pass outside probate.
The mistake I see most often
